Circular No. 19/2019/TT-BCT dated September 30th, 2019 of the Ministry of Industry and Trade on imposition of special safeguard measures to implement the CPTPP

This Circular provides for principles, procedures for imposition of special safeguard measures on imported goods on which duties are reduced or eliminated under the CPTPP, including safeguard measure during the transition period and emergency measure for textile and apparel products. 

In which, the safeguard measure applied during the transition period (from 3 - 5 years from the date of entry into force of this Agreement) means the measures as regulated at Article 99 of the Law on foreign trade management and Article 6.3 Chapter 6 of the Agreement (Clauses 5,6 Article 3).

The emergency measure for textile and apparel products means the measures regulated at Article 99 of the Law on foreign trade management and Article 4.3 Chapter 4 of the Agreement (Clause 8 Article 3).

However, a special safeguard measure shall not be imposed on any goods, on which a safeguard measure under the Law on foreign trade management is being imposed or to which a tariff rate quota is being applied, and shall not be imposed more than once on the same goods.

The Circular takes effect from November 14, 2019.
